Among these risks is the risk of injury from participation in the physical activities, including

TRAUMA FROM PHYSICAL CONTACT WITH PARTICIPANTS, EQUIPMENT, OR PLAYING SURFACE • LACERATIONS • BROKEN BONES • HEAD/EYE INJURIES • BRAIN DAMAGE • TRAUMATIC BRAIN INJURY • PARALYSIS • BACK/NECK/SPINE INJURIES • LIGAMENT AND TENDON INJURIES • MUSCLE INJURIES • HEART ATTACK • STROKE • DEATH

I acknowledge that these are inherent risks of the club and that I will be exposed to each of these risks by exercising my choice to participate in this Club.

I understand that Cornell University does not provide any Accident or Medical Insurance with respect to the activities of the Club and that I am expected to provide my own Accident and Medical Insurance.  I hereby agree that I am financially responsible for all such expenses whatsoever.

CLUB IS INDEPENDENT ORGANIZATION: I understand that this Club is registered and operated as an independent student organization under procedures established by the Campus Activities Office, with such membership requirements as the Club itself establishes.  I understand that this Club's activities take place subject to the rules and principles set forth in the Student Code of Conduct, to protect and promote Cornell University’s educational purpose.  I acknowledge that Cornell University does not supervise, run, or participate in the activities of this Club. That means Cornell has not made any assessment of my health, fitness, or skill level to participate in this Club, or my ability to use any equipment that may be used by this Club.

ASSUMPTION OF RISKS:  I understand and agree that, by signing this Agreement and participating in this Club and in its activities, including use of any facility, property, and equipment, and any travel associated with this Club, I will be exposed to the above-listed risks.  I am voluntarily assuming all such risks.  I agree that I am responsible for deciding whether to participate in this Club’s activities, including deciding whether I have the degree of skill required to participate in any particular activity.

WAIVER OF CLAIMS:  In consideration of the opportunity to participate in this Club, which may include use of Cornell facilities, equipment, and property, use of Club equipment, and travel associated with this Club, I hereby waive all claims against Cornell University and the above-named Club, their respective officers, coaches, advisors, agents, volunteers, and employees (collectively, “Released Parties”) from any liabilities, damages, expenses, causes of action, claims, or demands of any nature whatsoever, including any claims of negligence, on account of personal injury, property damage, death, or accident of any kind related to my participation in this Club, however caused, except in the event of gross negligence.  I intend for this waiver to bind my family members, heirs, executors, administrators, representatives, and assigns, as well as myself.

COVID- 19 Assumption of Risk, Waiver, and Release of Liability: I understand and acknowledge that COVID-19 is a global pandemic and a public health risk. I understand that the risk of becoming exposed to or infected by COVID-19 at Cornell University may arise from the actions, omissions, or negligence of myself and/or others. I recognize that the University cannot limit all potential sources of COVID-19 infection. I knowingly and voluntarily assume all risks, including but not limited to, the risk of illness, death, bodily injury, disability, or exposure or infection with COVID-19, for myself, and my family. I fully understand the risks, I knowingly and voluntarily waive the Released Parties from all present and future claims of any type, including negligence, for any harm or loss, including but not limited to, economic loss, personal injury, disease, death, or property damage suffered by me or my family, as a result of my participation in a Cornell University program or activity or as a result of my presence on Cornell University’s campus. I agree to indemnify, hold harmless, and covenant not to sue the Released Parties for any personal injury, death, medical expenses, disability, loss of capacity, property damage, court costs, attorney’s fees, or other loss arising out of this program/event.

This Agreement to Assume Risks and Waive Claims shall be governed by the laws of the State of New York, without regard to conflicts of laws principles.  I agree that any dispute about the terms of this Agreement shall be presented to a court of competent jurisdiction in the State of New York with a venue in Tompkins County.

I certify that I am in good health and have no physical limitations that would preclude my safe participation in this Club.  I further certify that I am 18 years of age or older and I have read and understood this Agreement, intending to be legally bound by its terms.
